Our fixed fee applies when your EPAs are straightforward, meaning they meet the following conditions:
What’s Covered in Our Fixed Fee?
✔ Attorney Appointments:
- Personal Care & Welfare EPA – You are appointing one attorney, with up to two successor attorneys.
- Property EPA – You are appointing up to two attorneys, with up to two successor attorneys.
- The same attorneys and successor attorneys are appointed for both EPAs (but may be in a different order).
✔ Scope of Authority:
- The EPA applies to all of your affairs, with no restrictions or specific limitations.
- There are no special conditions included in the documents.
✔ Clear & Timely Instructions:
- You provide all required information promptly so we can complete your documents efficiently.
- There are no significant changes to your instructions after the documents have been prepared.
✔ Capacity & Potential Disputes:
- If you are elderly, you already have a medical letter confirming you are capable of understanding and signing the EPA.
- There is no anticipated dispute over who you are appointing or whether you have the mental capacity to sign the documents.
What’s Not Included in the Fixed Fee?
Our fixed fee covers the preparation of your EPA documents, but some situations require additional work, which may involve extra costs. These include:
✖ Attorney Signatures:
- Arranging for your attorneys to sign the documents is usually handled by the donor to reduce costs. If you need our assistance, we can help at our hourly rates.
✖ Revoking Previous EPAs:
- If you have previously appointed attorneys and need to formally revoke those documents, we can assist for an additional fee.
✖ Estate Planning & Asset Protection Advice:
- If you need guidance on estate planning, wills, or asset protection, we offer dedicated estate planning sessions—ask us for details!
✖ Potential Disbursement Costs:
- We do not anticipate extra costs in most cases. However, if we need to arrange signing by your attorneys, courier fees within NZ are typically $10 (including GST) per delivery.
